DA Gonzalez Celebrates Violating First Amendment Rights

On September 10, 2024, District Attorney Deborah Gonzalez was sued in Federal Court for violating the constitutional rights of one of her constituents. The Court scheduled an emergency hearing on October 7 to consider the Plaintiff’s request for a preliminary injunction.

On September 25, 2024, the attorney for District Attorney Gonzalez sent an offer of judgment and letter explaining the recent actions she has taken to correct prior conduct related to improper viewpoint censorship. In outlining the details, it was stated that District Attorney Gonzalez had: (1) removed any limiting filters or bans of content or users; (2) ended any removal or deletion of comments; (3) provided full access to these social media pages for any user that the social-media service permits to use the platform for all social media accounts related to the District Attorney’s Office. She also agreed to pay $1.00 in damages in her offer of judgment.

To the extent District Attorney Gonzalez agreed to the corrective action prior to being ordered to do so at the October 7 hearing, the case was settled on October 7 when the Plaintiff accepted the offer of judgment. The Federal Court then issued an order and judgment against District Attorney Gonzalez in favor of Plaintiff on October 9, 2024.

Interestingly, District Attorney Gonzalez then issued a social media post claiming victory for “settling” a case that involved her obvious admission of violating the plaintiff’s constitutional rights and agreement to correct the behavior. How is that a victory? Why would a public servant celebrate admitting publicly via a Federal Court proceeding to improper conduct?
