The Defendant was charged with (1) theft by taking and (2) cargo theft. A jury trial was conducted in Athens-Clarke County beginning on March 27, 2023. The District Attorney’s Office failed to provide any evidence to the jury in support of the charge related to cargo theft. As a a result, the Defendant’s attorney moved for a directive verdict on that count which was granted by the Judge. After the trial, the jury found the Defendant Not Guilty on the theft by taking charge. This is an interesting situation as the Defendant was accused of stealing a cargo truck loaded with alcohol on or about April 15, 2022.
This same Defendant has had numerous other arrests in Athens-Clarke County for theft-related issues. In Case No. SU-22-CR-0249-N, the Defendant was arrested for (1) Fleeing or Attempting to Allude an Officer, (2) Reckless Driving, (3) Theft-by-Taking – felony, and (4) Possession of Tools for the Commission of a Crime. The incident date was December 27, 2020. Due to the failure of the District Attorney’s Office to properly obtain an indictment from the Grand Jury regarding these charges, the case was dismissed on October 19, 2022.
Mr. Wynn was also arrested on September 18, 2021 for (1) Theft by Taking – felony and (2) Possession of Tools for the Commission of a Crime. It was alleged he stole a 2005 Ford F450 owned by a local towing company. In Case No. SU-22-CR-0987-N, a jury trial was commenced on December 12, 2022 resulting in a Not Guilty verdict on December 14, 2022.
